    SCIA Firstly Explores Appellate Arbitration Procedure in China

     

    On December 23, 2018, Shenzhen Court of International Arbitration (also known as "Shenzhen Arbitration Commission" and "South China International Economic and Trade Arbitration Commission", formerly known as "China International Economic and Trade Arbitration Commission South China Sub-commission" and "China International Economic and Trade Arbitration Commission Shenzhen Sub-commission", hereinafter the “SCIA”) released its new arbitration rules and new panel of arbitrators. The SCIA new panel come from 76 countries and regions, basically covering all the major countries along the “Belt and Road”, which lays a solid foundation for Shenzhen to build a hub of "Belt and Road" international commercial dispute resolution. Mr. LUO Dongchuan, Vice President of the Supreme People's Court of China (the “SPC”), and Mr. WANG Lixin, Vice Mayor of Shenzhen Municipal People’s Government, have attended the SCIA New Arbitration Rules Release and Arbitrator Training Conference.

     

     

    Mr. LUO Dongchuan, on behalf of the SPC, congratulated the new development of the Shenzhen Special Economic Zone on international arbitration and talked about the spirit of the Central Committee concerning the establishment of the "Belt and Road" international commercial dispute settlement mechanism and the "one-stop" diversified settlement mechanism for international commercial disputes led by the SPC. Mr. LUO Dongchuan pointed out that the incorporation of SCIA, representative of the international arbitration institutions from Guangdong, Hong Kong and Macao Greater Bay Area, into the mechanism represents the international credibility of China's arbitration gained through its innovation and development based in Shenzhen.


     
     

    Mr. WANG Lixin pointed out that at the 40 anniversary of China’s reform and opening up, Mr. LUO Dongchuan’s special visit to Shenzhen and his talk about the spirit of the Central Committee concerning the establishment of the "Belt and Road" international commercial dispute settlement mechanism and diversified settlement mechanism for international commercial disputes led by the SPC to guide the development of international arbitration in Shenzhen will, for sure, further promote a more market-oriented, international and legalized business environment in Shenzhen.

     

     

    Mr. LIU Xiaochun, President of SCIA, interpreted the new SCIA arbitration rules at the training conference. The new arbitration rules have four major highlights: first, to insist on party centrality and further enhance party autonomy, SCIA takes initiative to launch a new mechanism for arbitrators and parties to read out declarations at the hearing; second, the new arbitration rules promote and protect bona fide cooperation; third, SCIA, based on domestic conditions, learning from international practice and responding to market needs, explores the optional appellate arbitration procedure for the first time in China and formulates SCIA Guidelines for the Optional Appellate Arbitration; fourth, the new rules adopt more measures to strengthen diversification, specialization, efficiency and low cost. 

     

     

    Ms. GAO Xiaoli, Deputy Chief Judge of the Civil Adjudication Tribunal No. 4 of the SPC, interpreted the supporting documents of the "Belt and Road" international commercial dispute settlement mechanism issued by the SPC this December. SCIA was the sole arbitration institution in Guangdong, Hong Kong and Macao Greater Bay Area that has been included, among the first group of arbitration and mediation institutions, into the "one-stop" diversified settlement mechanism for international commercial disputes.

     

    Nearly 400 arbitrators at home and abroad have attended the training conference.
